Terms and conditions of use
The website www.beneteau.com (the ‘Website’) is subject to the terms and conditions of use set out below.
SPBI reserves the right, at its sole discretion, at any time and without notice, to modify, change, supplement or delete all or part of these terms and conditions of use of the Site. Users are therefore invited to consult them regularly.
BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE, WITHOUT LIMITATION OR RESERVATION; IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE.
Description of the Site
The Site provides a general presentation of the BENETEAU range of products and services, the BENETEAU dealer network, and boat shows and other events.
Access to the Site and use
Access to the Site is free for users.
Users of the Site are solely responsible for their use of the Site, their behaviour and their actions. Users must not use the Site for any illegal or prohibited purpose, or to encourage any illegal activity or activity that infringes the rights of SPBI or third parties. SPBI shall not be liable in any way for any legal action taken against the user as a result of their use of the Site or their failure to comply with these terms and conditions of use.
The use of certain services on the Site may require the creation of a personal account with a username and password. The User is solely responsible for maintaining the confidentiality of the information relating to their account, including their password, and for all operations carried out under their account.
Access to services requiring the creation of a personal account is only possible for users who have obtained the lawful activation of an account by SPBI. Failure to do so would constitute the offence of fraudulent access to an automated data processing system, punishable by the penalties applicable in this area (Article 323-1 et seq. of the French Penal Code).
To create a personal account, the user undertakes to provide all information marked with an asterisk in the forms on the Website. Failure to do so will result in the account creation request being rejected. An account activation link will be sent to the user by email so that they can complete their registration.
Users who hold a personal account undertake to notify SPBI of any changes to their situation by updating their account information.
The user may delete their account at any time. In such a case, all information in their account will be deleted and certain services will no longer be accessible.
For Website services subject to general terms and conditions of sale (GTC), the request to delete the user's account can only be successful if the user is up to date with their payments to SPBI.
In the event of inactivity on the account for an uninterrupted period of two (2) years or in the event of non-compliance by the user with these T&Cs and/or, where applicable, the GTC applicable to the services, SPBI reserves the right to block all or part of the user's personal account or to delete it.
Content of the Site
Intellectual property
All trademarks, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, as well as all computer applications that may be used to operate the Site and, more generally, all elements reproduced or used on the Site are protected by the laws in force under intellectual property.
They are the sole property of SPBI or its partners.
Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of SPBI, is strictly prohibited.
The fact that SPBI does not take legal action as soon as it becomes aware of such unauthorised use does not constitute acceptance of such use or a waiver of its right to take legal action.
Information on products and services
The information published on the Website is of a general and informative nature and is provided for information purposes only. It does not constitute a legal commitment or contractual agreement on the part of SPBI, which reserves the right to modify the characteristics of the products at any time.
The prices of boats appearing on the Site are for information purposes only. These are maximum recommended prices, subject to change and established in accordance with French regulations. For accurate and up-to-date information, particularly regarding prices, availability, specifications, content and variants of the various boats appearing on the Site, users are invited to contact the BENETEAU network dealer of their choice. Members of the BENETEAU network independently set the prices of the products and services they sell.
The information contained on the Site is written in English but is translated into other languages to facilitate understanding by users. English is the reference language for its preparation and interpretation. The translations are as faithful as possible to the original English version. In the event of any discrepancies or inconsistencies between a translated version and the English version, the English version shall prevail.
SPBI will make every effort to ensure the accuracy of the information available on the Site. SPBI does not guarantee the reliability, performance or completeness of the Site or its content for the use that the user wishes to make of it. SPBI also does not guarantee that the Site or its content will be free of errors or that any defects will be corrected.
Hypertext links
The creation of hypertext links to the Site is subject to the express prior consent of SPBI.
SPBI cannot be held liable for hypertext links to other sites from the Site.
Any information accessible via a link to other sites is not under the control of SPBI, which declines all responsibility for their content.
Technical information
SPBI is subject to an obligation of means towards users in the provision of the Site and its operation. SPBI reserves the right to take any of the following actions at any time and without notice:

SPBI cannot be held liable in the event of interruption or suspension of services and/or the Site. In any event, the resulting malfunctions and unavailability of services shall not give rise to any compensation for the user or third parties.

SPBI does not guarantee that files and data downloaded from the Site will be uninterrupted, error-free or free from viruses, Trojan horses, contamination or malicious functionality. SPBI cannot be held liable for any damage or virus that may damage or render unusable the user's computer equipment following a visit to the Site. SPBI disclaims all liability for the acts or behaviour of third parties associated with the use of the Site.
The Site and its content are provided on an ‘as is’ and ‘as available’ basis. SPBI cannot be held liable for any interruption or suspension of the Site. In any event, the resulting malfunctions and unavailability of services shall not give rise to any compensation for the user or any third party.
SPBI cannot be held liable for any indirect, incidental or consequential damages, whether foreseeable or unforeseeable, caused to the user or to a third party, including loss of earnings or profits, loss of data or equipment, including the costs of recovering, reproducing or repairing such losses.
In any event, SPBI's total liability shall be limited to a maximum lump sum of fifty (50) euros in all other cases.
